Terms of service — ELSA software

The German version is legally binding. This English text is provided for information. These terms govern use of the ELSA workshop software at app.elsa-tools.com. The provider is Umut Ceylan, trading as ELSA Tools, Bielefelder Str. 87, 32051 Herford, Germany.
1. Scope
ELSA is cloud software for repair workshops. The subscription grants access to the software. It is not a sale of physical goods.
2. Contracting party and payment
The contracting party for the software service is Umut Ceylan, trading as ELSA Tools.
Subscription payments are processed by Paddle. Paddle acts as merchant of record, collects payment and issues the subscription invoice.
3. Contract formation
The contract is formed when you subscribe via the pricing page or in the application and Paddle confirms payment.
4. Service
We provide ELSA as software access, including job intake, diagnosis, repair, completion, customer status and workshop administration, depending on the plan.
The software is provided over the internet. 100 percent availability is not guaranteed.
5. Prices and term
For the German market, the full ELSA subscription is EUR 29.90 net per month. The annual price is EUR 328.90 net (eleven monthly prices). Statutory VAT is added where applicable.
Other markets may have a different plan. The price shown before checkout is binding.
The subscription renews automatically until cancelled. You may cancel effective at the end of the current billing period in billing settings or by email to webmaster@elsa-tools.de.
6. Trial
Where offered, you may try ELSA for 30 days without payment details. Continued use after the trial requires a paid subscription.
7. Withdrawal and refunds
Consumers have a statutory right of withdrawal. In addition, the ELSA subscription includes a 30-day refund. Details are at /widerruf.
8. Customer duties
You are responsible for access credentials, lawful use and content you enter.
You remain the controller for personal data of your workshop customers.
9. Liability
We are fully liable for intent and gross negligence, under the German Product Liability Act, and for injury to life, body or health.
For slight negligence affecting essential contractual duties, liability is limited to foreseeable, typical damage. Other slight negligence is excluded.
10. Final provisions
German law applies. Mandatory consumer protection of your country of residence remains unaffected.
